IMPORTANT — READ CAREFULLY. By installing, copying, or using TM DRAKE SLS
("Software"), you agree to this EULA. If you do not agree, do not install or use
the Software.
This document is a practical software license for field use. It is not a
substitute for legal advice. Governing law is that of the publisher's principal
place of business unless you and the publisher agree otherwise in writing.
1. LICENSE GRANT
----------------
Subject to this EULA and a valid license status (see §3), TM Drake grants you a
personal, non-exclusive, non-transferable (except as allowed in §4), revocable
license to install and use the Software on Windows devices you own or control
for lawful field investigation, research, education, or personal use.
The Software is licensed, not sold. All rights not expressly granted are reserved
by TM Drake.
2. WHAT YOU MAY DO
------------------
- Install the offline Setup on your Windows 10/11 PCs or investigation tablets.
- Use the Software with compatible Kinect v1 (or compatible) hardware.
- Activate with an offline license key issued by TM Drake (or use an authorized
trial as described in §3).
- Make reasonable backup copies of the installer for your own use.
3. TRIAL AND PAID KEYS
----------------------
Public / retail builds may include:
(a) a time-limited clock trial (e.g. 14 days from first run), and/or
(b) time-limited trial keys, and/or
(c) permanent full keys after purchase.
Private field builds supplied by TM Drake for internal kits may run unlocked.
When a public trial ends, the Software may block live field features until you
activate a valid key. Purchase and key delivery are handled via
https://para.tmdrake.com/ and related communications (e.g. email). Payment
processing (e.g. Stripe) is subject to the processor's terms.
Keys are for authorized use only. Do not share, sell, or publish keys.
4. TRANSFER

You may transfer a full license to another person only if you permanently stop
using the Software and transfer the key and this EULA. Trial keys are not
transferable.
5. RESTRICTIONS
---------------
You may not:
- Reverse engineer, decompile, or disassemble the Software except to the extent
applicable law expressly allows despite this limit.
- Remove or alter proprietary notices.
- Rent, lease, sublicense, or commercially redistribute the Software or keys as
your own product.
- Use the Software for unlawful surveillance or any illegal purpose.
- Circumvent license, trial, or activation mechanisms.
6. THIRD-PARTY COMPONENTS

The Software and installer may bundle third-party components (including but not
limited to Microsoft Kinect Runtime components, FFmpeg, and .NET redistributables).
Those components remain subject to their own licenses. See NOTICE.txt shipped
with the Software and at https://para.tmdrake.com/legal/notice.html
"Kinect" is a trademark of Microsoft Corporation. TM Drake is not affiliated with
or endorsed by Microsoft.
7. NO WARRANTY ON "RESULTS"
---------------------------
The Software provides depth, skeleton (SLS), audio visualization, word generation
(DrakeVox), and related field tools. TM Drake does not warrant that the Software
will detect, identify, or prove any particular event, entity, or "paranormal"
phenomenon. Field results depend on hardware, environment, and operator practice.
8. DISCLAIMER OF WARRANTIES
---------------------------
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SOFTWARE IS PROVIDED "AS IS" AND
"AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TM DRAKE AND ITS SUPPLIERS SHALL NOT BE
LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES,
OR ANY LOSS OF DATA, PROFITS, OR BUSINESS, ARISING FROM USE OF THE SOFTWARE.
TM DRAKE'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THIS EULA OR THE SOFTWARE
SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE LICENSE IN THE TWELVE (12) MONTHS
BEFORE THE CLAIM (OR USD $49.99 IF YOU PAID NOTHING).
Some jurisdictions do not allow certain limitations; in those cases the above
limits apply to the fullest extent permitted.
10. HARDWARE AND SAFETY
-----------------------
You are responsible for safe use of cameras, power supplies (including 12 V
bricks), tablets, and vehicles/locations. Follow electrical and site safety rules.
TM Drake is not responsible for third-party hardware failure or misuse.
11. UPDATES AND SUPPORT
-----------------------
Updates, if any, may be provided at TM Drake's discretion. Support is typically
by email ([email protected]) as described on the store site. Trial keys may be
issued for support windows.
12. TERMINATION
---------------
This license ends if you breach this EULA. On termination you must stop using the
Software and destroy copies in your possession, except as required by law. Key
sections that by nature should survive (disclaimers, liability limits, ownership)
will survive.
13. PRIVACY
-----------
The desktop app is designed for offline activation and does not require continuous
cloud login. Payment and checkout on the website may be processed by third parties
(e.g. Stripe). See the store site for contact and any posted privacy notes.
